Agreement to these terms
By accessing devinfuse.com or engaging DevInfuse for any service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.
Our services
DevInfuse provides web and software development, WordPress, Shopify, WooCommerce and Laravel development, SEO, UI and UX design, website maintenance and performance optimisation. The specific scope, deliverables, timeline and price for any engagement are set out in a separate written proposal or statement of work, which forms part of these terms.
Quotes and project scope
Quotes are based on the information you provide and the scope agreed at the time. Changes to scope may affect the timeline and cost and will be confirmed in writing before work continues.
Fees and payment
Fees, payment milestones and schedules are defined in your proposal. Unless stated otherwise, invoices are due within the period noted on the invoice. Work may be paused if payments are overdue.
Intellectual property
On full payment for a project, ownership of the final deliverables and custom code we create for you transfers to you, unless your proposal states otherwise. We retain ownership of our pre-existing tools, libraries and know-how, and may reuse general skills and non-confidential techniques. Third-party and open-source components remain under their own licences.
Your responsibilities
You agree to provide timely feedback, content, access and approvals needed for us to deliver the work, and to ensure that any materials you supply do not infringe the rights of others.
Confidentiality
Each party agrees to keep the other partys non-public business and technical information confidential and to use it only for the purpose of the engagement.
Third-party services and links
Our work and website may rely on or link to third-party services and websites. We are not responsible for the content, availability or policies of third parties.
Warranties and disclaimers
Our services are provided with reasonable skill and care. Except as expressly stated, the website and services are provided as is without further warranties of any kind. We do not guarantee specific search rankings, traffic or business outcomes.
Limitation of liability
To the fullest extent permitted by law, DevInfuse is not liable for indirect, incidental or consequential losses. Our total liability for any claim arising from an engagement is limited to the fees paid for that engagement.
Indemnification
You agree to indemnify DevInfuse against claims arising from content or materials you provide, or from your misuse of the deliverables or website.
Termination
Either party may end an engagement in writing. You remain responsible for fees for work completed up to the termination date.
Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms from time to time. The current version is always available on this page, with the last updated date shown below.
Governing law
These terms are governed by the laws of the jurisdiction in which DevInfuse operates. Any disputes will be handled by the courts of that jurisdiction.
